Immigration Law " Michael D. Patrick, a partner at Fragomen, Del Rey, Bernsen & Loewy, writes that U.S. employers have just emerged from the hectic period for filing H-1B petitions on behalf of the highly skilled foreign workers they wish to employ in Fiscal Year 2009. Antitrust Trade and Practice "Neal R. Stoll and Shepard Goldfein, partners at Skadden, Arps, Slate, Meagher & Flom, write that the FTC has long advocated that a settlement where the patent holder pays the alleged infringer for deferring its entry is illegal under the antitrust laws. Zaytsev, an associate at the firm, write that sellers engaged in corporate and real property auctions should take note of a recent decision by the U.S. District Court for the Southern District of New York in which a losing bidder's fraud claims against the seller of a commercial high-rise building in midtown Manhattan were allowed to proceed. TECHNOLOGY TODAY:
Tackling the 21st-Century 'Signature' "Stephen M. Kramarsky, a member of Dewey Pegno & Kramarsky, writes: One of the major frustrations for lawyers in technology-rich practice areas is the almost universal truth that business tends to adopt technological innovation much faster than the law can adapt to it. The older the legal framework, the more likely it is to create unexpected results in the face of new ways of doing business. These issues have recently been confronted in a series of decisions pitting one of the most ancient concepts in common law, the statute of frauds, against the increasingly widespread practice of "papering" very substantial business arrangements through e-mail.
