SF Bay Area Docket (Nov. 2008)

By Kevin Underhill

ADVERTISEMENTS

The following cases were filed in San Francisco Bay Area courts during the past two weeks:

Wendell Joost Jr. v. Guerneville Business Corp. dba Russian River Resort; et al., No. SCV243949 (filed 11/12/2008) Action for nuisance and trespass. The plaintiff seeks declaratory relief from the loud amplified sound system of defendant Russian River Resort, which is a "bathhouse/spa/lodging establishment that caters to a particularly rowdy and sexually explicit crowd."
Tara Collins and Liz Veldez, individually and on behalf of all others similarly situated v.Kellogg Company, et al., No. CGC-08-481911 (filed 11/14/2008) Class action complaint for unfair business practices. The defendants market and sell cereals, meal bars, and water mix by conveying a consistent, false and misleading message to consumers that eating Special K products can cause weight loss or suppress consumers' appetites. They claim that Special K products can cause consumers to "drop a bathing suit size in 2 weeks" and that the products make consumers "feel fuller longer."
Lonnell Worthy v. Bank of America, No. CGC-08-482136 (filed 11/20/2008). Contract action where the plaintiff's Apple i-Pod playlist is at issue. $1 trillion.
Cindy Lee v. Deja Vu San Francisco dba Centerfolds, and Christianna Rogers, No. CGC-08-482122 (filed 11/20/08) Complaint for negligence and premises liability. The plaintiff was seriously injured when defendant Rogers kicked her in the face with a high-heel shoe, which was possible because defendant Deja Vu's audience seating was positioned too close to the stage.

Mr. Worthy, who must have one hell of a playlist, is representing himself.
