Harnik, a partner at Harnik Wilker & Finkelstein, and Christian Votava, an associate at the firm, whether characterized as the state itself or an 'agency or instrumentality' of the foreign state, service of process on a foreign central bank regardless of the existence or designation of its U.S. presence should have to be made exclusively under §1608(a). Until such time as the FSIA may be so amended, they conclude, foreign central banks with offices in the United States may be advised to seek to acquire consular status."
