Free With Registration: Medical Malpractice "Thomas A. Moore, a senior partner of Kramer, Dillof, Livingston & Moore, and Matthew Gaier, a partner at the firm, write that whether a physician-patient relationship between the injured person and the doctor whose treatment is being criticized is one of the more vexing issues in medical malpractice litigation and a recurring theme in appellate decisions. One type of case which has often hinged on the determination of whether there was a physician-patient relationship involves a physical examination undertaken not for the purpose of treatment, but to evaluate the person examined for the benefit of third parties such as insurers, employers or adversaries in personal injury litigation. A recent Appellate Division opinion has taken a new view of such cases."

Ruling Helps Clarify When Parents May Be Liable for Children's Acts "Brian P. Heermance, a partner at Morrison Mahoney, and Kevin A. Hickman, an associate at the firm, review a recent decision that underscores a common question many parents face, which is whether and to what degree they may be held legally responsible for the negligent acts of their children. They examine various theories of liability and discuss situations where parents may be held liable to third parties for the wrongful acts of their children."

"Jay Sullivan, a partner at communications consulting firm Exec|Comm and a former practicing attorney, writes: You didn't become partner by mistake. You worked hard, consciously decided you wanted to achieve this goal, and kept your eyes on the prize. Now isn't the time to sit back and enjoy the ride. If you do, the ride will be pretty short and disappointing. Now is the time to develop a clear goal of where you want your career to lead."
TECHNOLOGY TODAY:
Privacy Concerns " David Bender writes that a recent ruling indicates that the Foreign Intelligence Surveillance Court of Review is not averse to balancing the Fourth Amendment interest in prohibiting unreasonable searches and seizures against the interest in protecting national security."
