FROM THE UPCOMING ISSUE | Deferred, nonprosecution deals fall by 60%
"The number of deferred and nonprosecution agreements between the U.S. Department of Justice and corporations declined by 60% in 2008 ? from a historic high of 40 in 2007 to 16 last year, according to a forthcoming study. Despite the lower numbers, violations of the Foreign Corrupt Practices Act continued to dominate the subject of those corporate pretrial agreements, with seven of the 16 agreements last year resolving FCPA violations."
"President Barack Obama announced on Wednesday a $500,000 cap on senior executive pay for companies receiving substantial federal bailout money. In one of the more aggressive moves to rein in executive compensation, which has been heavily scrutinized in recent years, Obama called excessive bonuses paid to executives of firms that are being propped up with taxpayer funds the 'height of irresponsibility.' Littler Mendelson's Stven Friedman said the move could discourage companies from seeking government bailouts while giving a recruiting advantage to competitors that do not receive federal funds."
"A Texas appeals court has freed Proskauer Rose from a tax shelter case in which the plaintiff is a prominent Houston trial attorney. The action alleged that Proskauer Rose was liable for providing an opinion letter pertaining to a tax shelter developed by the accounting firm Ernst & Young."
"A Minnesota accounting firm has been hit by lawsuits alleging that it failed to detect problems in two separate Ponzi schemes ? the purported $50 billion investment scam by New York financier Bernard Madoff and the $3.5 billion alleged 'electronics' scheme by Thomas Petters. "

WEB-ONLY | State AGs urge financial regulators to set aside turf battles and work to prevent foreclosures
"A working group of state attorneys general has urged the Office of the Comptroller of the Currency and the Office of Thrift Supervision to put aside regulatory turf battles and to work with the group to develop a comprehensive report on the efforts of mortgage servicers to prevent foreclosures. "
"State budget crises, coupled with prison overcrowding, led many states last year to re-examine prison-related policies and to enact reforms in the areas of sentencing, drug policy, parole revocation, racial justice, juvenile justice, felony disenfranchisement and higher education in prison, according to a new report. The Sentencing Project, a national nonprofit organization engaged in research and advocacy on criminal justice policy issues, reported that 17 states enacted sentencing and corrections policy reforms in 2008."
"The Illinois commission that tracks attorney registration in the state has dropped nearly 600 lawyers from its list of those qualified to practice in the state, citing their lack of compliance with new continuing legal education requirements."
WEB-ONLY | Despite an array of legal maneuvers, gangs are the 'new Mafia'
"Nearly one million gang members belong to 20,000 gangs scattered across all 50 states, according to a new national gang assessment report by the National Drug Intelligence Center. The daunting numbers come despite legal efforts on a variety of fronts to combat the growth of gangs in the past 30 years. In San Francisco, the city attorney's office has successfully employed civil injunctions against gangs to roust them from high-crime turf and impose curfews."
