MEDICAL MARIJUANA LAW MOVES CLOSER TO PASSAGE
"The state Legislature on Thursday took another step toward making New Jersey the 14th state to allow the legal use of marijuana by those with chronic or terminal illnesses. The Assembly Health, Human Services and Senior Citizens Committee voted to recommend passage of the New Jersey Compassionate Use Medical Marijuana Act, A-804, clearing the way for a vote by the full house. At the request of the sponsors, the bill was amended to restrict who can prescribe medical use of marijuana and who can distribute it, also removing a provision that would have allowed home growing in limited amounts."
RULING ON EVE OF GM CHAPTER 11 SAVES DEALER FROM GOING UNDER
"On the last business day before General Motors' bankruptcy, a federal judge granted a Saturn dealer an injunction against the giant automaker, and the dealer says the timing saved his business. U.S. District Judge Dennis Cavanaugh in Newark enjoined GM from exercising a contractual right to bar Stuart Lasser from opening a KIA dealership alongside the Saturn of Denville franchise he has owned since 1991. Besides ending with a hairbreadth escape, the case is an example of how GM sales outlets across the country are scrambling to save their businesses as the company tries to redesign itself as a compact model, partly by shedding hundreds of dealerships."
SETTLEMENT REACHED IN CLASS SUIT OVER WALGREEN 'COLD PREVENTION' PILLS
"A federal judge in Newark gave tentative approval on Wednesday to a $1.4 million settlement of a class action over Walgreen Co.'s claims that a line of its multivitamins can prevent colds. The settlement, in Geis v. Walgreen Co., 2:07-cv-4328, would require Walgreen to stop saying that its Wal-borne vitamins can strengthen the immune system and protect users from airborne viruses. It would offer a refund of up to $15, or a flu shot valued at $25, to anyone who bought Wal-borne vitamins between 2001 and last March 31. U.S. District Judge Katharine Hayden will hold a hearing on Nov. 2 to decide on final approval."
ALLEGEDLY TAINTED BEANS PROMPT CLIENT'S SUIT VS. DAY PITNEY
"A longtime client has sued Day Pitney and litigation partner Robert Rose in a case involving an international insurance company, a vanilla importer, and thousands of pounds of vanilla beans allegedly tainted with mercury. International Flavors & Fragrances, a Dayton, New Jersey-based producer of tastes and smells used by household products and food and beverage makers, filed suit in New Jersey Superior Court last month against the firm and Rose claiming negligence and professional malpractice, breach of fiduciary duty, and unjust enrichment. In the complaint, IFF claims Rose and Day Pitney failed to assert the company's claims in response to an insurer's suit in a timely manner."
ASSEMBLY PANEL PASSES FAIR DEBT COLLECTION PRACTICES ACT
"The Assembly Consumer Affairs Committee on Thursday recommended passage of a state analog to the federal Fair Debt Collection Practices Act, one that would restrict how a debt collector may communicate with a debtor. The chief sponsor, John Burzichelli, D-Gloucester, says the bill's purpose is to stop "rogue efforts that amount to harassment," such as calling debtors late at night or early in the morning; contacting them persistently at their workplaces; and sending letters in envelopes marked to indicate their purpose is to collect a debt. Violations would fall under the umbrella of the Consumer Fraud Act. "
