Introduced by Sen. Damon Thayer on February 12, 2008. Passed in the Senate (23 to 13) on February 19, 2008, to require an individual or group spending over five thousand dollars in support or opposition of a constitutional amendment to electronically file a weekly report when the legislature is in session with the Legislative Ethics Commission detailing all expenditures -- and their sources -- and all communications relating to that effort. The bill has similar reporting requirements specifically for lobbyists, including that a pro-rated portion of the lobbyist's salary reflecting time spent working on the constitutional amendment be reported. The bill requires the Legislative Ethics Commission to post each report required by this bill online within 24 hours of receipt. The bill specifies fines for unfiled reports and makes intentionally false or omitted statements on the reports felonies. The bill also requires any person or group receiving or spending more than $1000 on constitutional amendment advocacy to report to the Registry of Election Finance all contributions, expenditures and communications daily in the thirty days prior to the election, unless the person or group states no more than $3000 will be accepted or spent in one election. The provisions of this bill would become effective immediately upon enactment.
