Obama Set for First Win Among Circuit Nominees

"The Senate this afternoon is heading toward confirming Judge Gerard Lynch to a vacancy on the U.S. Court of Appeals for the 2nd Circuit, making him the first of Obama's circuit nominees to win approval. "

Grants to Examine Changes to Medical Liability

"President Barack Obama ordered today that $25 million be made available in grants to examine alternatives to the current medical liability system. The grants could mean changes for a system that the plaintiffs' bar has lobbied to protect, but they stop short of the nationwide limits on malpractice torts that doctors and insurance companies have sought".

D.C. Court of Appeals Crushes Open Container Case

"Earl Reid told the police officer that the drink at his feet was "just Kool-Aid," but the cop was incredulous. The D.C. Court of Appeals, however, was not. Reid won on appeal today. Maybe that drink was just Kool-Aid after all?"

DOJ: Extradition Hearings Are Not Mini Trials

"The government has no obligation to turn over exculpatory evidence during an extradition proceeding, a Justice Department lawyer said in court today in arguing against having a "mini trial" about Mexico's request to extradite alleged methamphetamine trafficker Zhenli Ye Gon."

Kennedy Memoir Shows Animosity Toward Rehnquist

"The passage of time did not soften Sen. Edward Kennedy's hostility toward Chief Justice William Rehnquist, if Kennedy's memoir is any indication. Kennedy, in a memoir published posthumously this week, argues that Rehnquist might not have been confirmed as an associate justice in 1971 if the Senate hadn't refused to confirm two of President Richard Nixon's earlier Supreme Court nominees."

Sotomayor on the Dance Floor

"The last time we heard much about a Supreme Court justice dancing was after Sandra Day O'Connor joined the Court in 1981. But on Tuesday night Justice Sonia Sotomayor did some pretty smooth dancing in spike heels with actor Esai Morales. It was at the National Hispanic Foundation for the Arts' "Noche Musical" at the Corcoran Gallery."
