Indian trust deal faces sharp scrutiny

'Last week, the Department of the Interior announced a $3.4 billion settlement that could bring an end to the long-running and often contentious Indian trust litigation. But there are still a few tall hurdles to overcome before the settlement is final.'

Federal judges push back against recusal proposals

"The federal judiciary is pushing back against members of the U.S. House who are considering revisions to the recusal process for judges.'

Healthcare reform means big bucks for K Street

"President Obama's proposed overhaul of the health care system has been, without a doubt, the biggest lobbying campaign of 2009. But while the big battles ? a government-run insurance plan, abortion coverage ? have taken up much of the public's attention, they haven't necessarily been the breadwinners for lobbyists. Some of the most lucrative and sensitive work has been on smaller issues that may have a big impact on a particular business. "

Three-judge panel to hear disciplinary case against Boston federal prosecutor

"District of Massachusetts Judge Joseph Tauro tapped a three-judge panel to hear a disciplinary case against Boston federal prosecutor Jeffrey Auerhahn, who faces sanctions for his alleged evidence disclosure misconduct. The court's local rules call for a three-judge panel in disciplinary enforcement cases if the attorney facing discipline desires a hearing or to resolve factual issues."

Privilege losses now lack immediate appeal

"Federal court orders requiring litigants to disclose information that they believe is protected by the attorney-client privilege do not qualify for immediate appeal, the U.S. Supreme Court ruled Tuesday. In her first opinion since joining the Court, Justice Sonia Sotomayor wrote that permitting successive, piecemeal appeals of all adverse attorney-client privilege rulings 'would unduly delay the resolution of district court litigation and needlessly burden the Courts of Appeals.' "

Justices seem skeptical of 'honest services'

"U.S. Supreme Court justices of all stripes appeared sharply critical on Tuesday of the federal law that makes it a crime to "deprive another of honest services," leaving the often-used prosecutorial tool in serious doubt."
