The 2010 Douchey Dick Award

ADVERTISEMENTS
[This is a fairly heavily revised version of my first post because, as someone so cleverly points out in the comments, the original post conflated bananas with mammals. Loosely speaking.]

The award goes to Leslie Brodie, of your @berkeley inbox fame. The award comes after Brodie reported one of our finest to the California Bar for reasons that are . . . wait, what were the reasons?

Apparently student A wanted to stop receiving emails from Diversity Organization B, and sent an over the top email to that effect and including legal jargon about the CAN-SPAM Act. Hard to find fault with that . . . I sent a pithy little zinger along similar lines to Barbara Boxer this morning (though without the legal footnotes).

Organization B offended by Student A's email, fired off a detailed letter to the California Bar helpfully informing the bar examiners of A's attempt to misstate the law for personal gain and helpfully suggesting that Student A is not qualified to practice law. As if anticipating the venom-storm this was likely to set off, Organization B also helpfully emailed DE and CC'd half of Boalt Hall. Letter here, or in your @berkelely.edu inbox.

Never mind that Organization B's legal analysis is shameful idiocy (i.e., should be dismissed for failure to state a claim other than total horse shit), because the damage has been done. And not just damage to the student, but damage to the diversity initiative as well: I hope your PR people take note when I say that based on the racist, inflammatory, and socially destructive language in that email, I will never support your organization, and you have destroyed your ability to network anything other than bad press within my social and professional circle, however small it may be.

As far as the rest of it, I am sure that many people would be happy to submit a letter or some other form of support to the state bar. Unless the facts are different from what I have set forth above, I'm certainly one of them.
