Beware the Poison Pen

ADVERTISEMENTS

No matter how strong the impulse to “tell ‘em how you really feel,” the proper venue might not be your appellate brief. This idea is brightly illustrated in a 2008 case before the Supreme Court of Vermont. The Court noted that the defendant’s briefs lacked “the professional tone we expect from members of the bar. The derisive references to the trial court’s ?hyperbole? and ?erudition,? and to the court’s decision as ?ludicrous,? ?inane,? ?risibl[e],? and ?disingenuous? distract from the arguments on the merits in this case and do not advance the quality of justice in Vermont.”

The case is Northern Sec. Ins. Co. v. Mitec Electronics, Ltd., 965 A.2d 447 (Vt. 2008). To see it, use the party names or citation as a search query in your service of choice.
