ADVERTISEMENTS

This morning the Court is expected to release orders starting at 10.  Afterward, it will hear oral argument in the following cases:

~10 a.m. ? The Court will consider in Renico v. Lett (09-338) whether a defendant’s Fifth Amendment right against double jeopardy is violated by the decision of a trial judge to declare a mistrial after the foreperson said the jury was not going to be able to reach a verdict.  My preview of the case is here.

~11 a.m. ? In Morrison v. National Australia Bank (08-1191), the question presented is whether the judicially implied private right of action under Section 10(b) of the Securities and Exchange Act of 1934 should, in the absence of any expressed congressional intent, permit fraud-on-the-market claims by foreign investors who purchased, on a foreign securities exchange, foreign stock issued by a foreign company.  Lyle Denniston discussed the major issues in the case last week on SCOTUSblog.
