Really Free Credit Reports from the Big Three Prior to Your Bankruptcy! Free! My Favorite Price for Free Credit Reports!

By Joseph McDaniel, Esq.

ADVERTISEMENTS
Here's the deal: you only get to file your Chapter 7 every eight years these days; under the New Code when I started practicing bankruptcy law, the time period was shorter.

All the more reason to get it right.

So make sure you list all your creditors, because one of the questions you'll be asked at the first meeting, under penalty of perjury, is whether you listed all your creditors. Note that it's also a bankruptcy CRIME to intentionally and fraudulently fail to list a creditor, so list 'em, darn it!

The word all is a word that is sometimes a little difficult to understand.

"So should I list a creditor if I want to pay him anyway?" Uh, yes.

"So should I list a creditor if I don't believe I really owe him anything?" Yes. Really.

"So should I list a creditor if they show on my credit report by mistake?" Yes.

"Do I have to list a creditor if I don't want to? Like Mom?" Yes, even Mom.

"If there's no paperwork and it's just an informal loan?" List them, darn it!

"Do I have to list them if they won't be discharged, like student loans?" Yes, list!!!

"Most taxes won't be discharged. Do I have to list them?" YES!!!!!

You can get an actually free credit report once a year from the big three credit reporting agencies, so you might as well.

I ask all of my clients to get all three credit reports so they don't forget any creditors. The credit report won't show all the creditors a debtor may have; it's just a safety net, to jog the debtor's memory, or a warning sign, in case there was some identity theft.
