: The UCL PractitionerThree cases of interest set for oral argument in late May and June
By Kimberly A. Kralowec
The Supreme Court has set three cases of interest for argument on its late May and June calendars.
Tuesday, May 25, 2010, 9:00 a.m. (San Francisco): Lu v. Hawaiian Gardens Casino, Inc., no. S171442. This case addresses whether Labor Code section 351, which prohibits employers from taking "any gratuity or part thereof that is paid, given to, or left for an employee by a patron," creates a private right of action for employees.
Wednesday, May 26, 2010, 9:00 a.m. (San Francisco): Reid v. Google, Inc., no. S158965. This is the case involving summary judgment motion standards.
Wednesday, June 2, 2010, 9:00 a.m. (Los Angeles): Clark v. Superior Court (Western Life Ins. Co.), no. S147229. This case addresses whether statutory penalties for elder abuse are recoverable as restitution under the UCL. It was set for argument amazingly fast.
I am not planning to attend any of these arguments. If you would like to do so and provide a report for posting here, please let me know by email (uclpractitioner@gmail.com).
