U.S. Court of Appeals Case No: 06-3959
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Per Curiam, with Riley, Bowman, and Smith, Circuit Judges]Defendant alleged that the federal prosecutor's striking an African-American juror who had an unstable job record; (3) was a substitute teacher; and (4) had a brother who served two consecutive terms in prison for burglary, robbery, and murder was race-based. Eighth Circuit affirms, as there were no Caucasian jurors who had all of the challenged factors the stricken venire member possessed, it is up to the District Court to decide the credibility of the federal prosecutor's reasons to strike the African-American juror.
