Jury Instruction Error Leads to Overturned Sentences for Utah Man

Warren Steed Jeffs, a ?prophet? in the Fundamentalist Church of Jesus Christ of Latter-Day Saints, had two convictions on charges of rape as an accomplice overturned last week due to erroneous jury instructions. Jeffs was accused and convicted based on allegations that he used his standing as a member of the Church to convince a fourteen year-old girl to marry her nineteen year-old cousin, thus making Jeffs an accomplice to statutory rape as defined by the law of most states. The Utah Supreme Court decided, however, that the jury instructions were in error because they viewed the existence of a ?position of trust? from the viewpoint of the wrong individual and thus created a strong possibility that Jeffs was found guilty based on that erroneous interpretation...continue to full post
