Baby Video Background Music: A New Low for Copyright Claims?

By Eric Lipman

ADVERTISEMENTS
Promoting the progress of science and useful arts is all well and good, but have we gone a little too far with this whole thing? First, we've got the "copyright troll" searching for news stories reposted by bloggers, purchasing copyrights and suing on them, without so much as the courtesy of a takedown request (as noted by Above the Law yesterday). Now there's also this post on Consumerist about YouTube flagging a video of a dancing baby as potentially violating Sony's copyright in the background music, in this case, the Shirley Temple ditty "The Codfish Ball." (I can't be sure, but, in the video below, it sounds like the baby may be grooving to the John Lithgow version.) It is worth noting that the poster of the adorable video didn't receive a takedown notice, YouTube just tacked on an ad, hoping to generate revenue for Sony. But the dancing baby's mom, identified only as Samantha, didn't dig that, so she pulled the video off YouTube herself, and reposted it at Vimeo ... and here it is: Copyright people: How far down the slippery slope are we, and where does it end?
