Legal Ethics Items (September 8, 2010)

ADVERTISEMENTS

  • In re Currency Management: a bankruptcy court pops a lawyer for using BK court to re-litigate claims that had been lost in state court.  Sometimes lawyers don't have a sense of when a dispute is over.  (Btw, the BK court's version of Rule 11 is Rule 9011, and is discussed in the case.)
  • Prof. Maura Strassberg (Drake) looks at MR 4.4 and intentional interference with former employee's non-disclosure agreements.  It's an issue that comes up fairly often, because some employers try to sweep everything into the NDAs and employment agreements, while lawyers are eager to get the former employees to talk.
  • In re Arledge: Louisiana disbars a lawyer who was involved in the Fen-Phen litigation.
  • Truth on the Market: Business law professor Larry Ribstein comments on the prospects that business interests will own the practice of law -- which was traditionally and still is against the ethics rules.  Of course, we are seeing business find ways around the restriction and the US legal profession is considering abolishing or altering them.  Ribstein also wrote The Death of Big Law and had commented earlier on "law entrepreneurs."
  • The San Jose Mercury News is live-blogging a sensational murder trial.  I wonder if they couldn't couple that with a live video feed.  Regardless, the boundaries of the court room seem to be vanishing in cyberspace.
  • In the Canadian context, Emir Aly Crowne-Mohammed argues against the suggestion that law students be governed by codes of professional conduct.
  • Robert Ambrogi rejects the argument that law blogs are dead.
  • The chief justice of Malta steps down and looks back.
  • From ALM: a survey of who represents the big companies in corporate America.
