Legal Ethics News (September 10, 2010)

ADVERTISEMENTS

  • New York Law Journal (h/t: TaxProf Blog): In the huge criminal trial arising from the Jenkins & Gilchrist tax opinion fraud, the judge has ruled that Sonnenschein cannot represent both a defendant and a cooperating witness.  (I may be mistaken but I think that Tanina Rostain and Mitt Regan are writing a book about the tax fraud affairs -- which will be a must read for legal ethics types.)
  • National Law Journal: associate salaries dropped, but not as much as many associate had feared.
  • Detroit Free Press: the discipline prosecutors have appealed the ruling that cleared Wilson Copeland III in the criminal and ethics scandals surrounding the former mayor.
  • In Washington, a lawyer who pushed unnecessary financial products to seniors with a living trust mill was suspended for two years.
  • California Attorneys Fees Blog: A $14 million attorneys fee bill, arising out of a bitter battle between author Clive Cussler and a publisher, was reversed and remanded.
  • In re V.V.: a California Court of Appeal clarifies how a court should proceed in a dependency case when a parent with retained counsel indicates that he or she wishes to retain new counsel.  The court noted that the method of dealing with such requests is similar to, but distinguishable from, the method for dealing with such requests in criminal proceedings.  In dependency proceedings, the best interests of the child must be considered when handling the requests.
