Akzo Nobel NV: European Court of Justice rejects privilege for in-house lawyers

ADVERTISEMENTS

Story here at The Lawyer, and covered lots of places in the blawgosphere.  Here's the decision.

The European tradition puts far more emphasis on the lawyer's independence and this ruling reflects a belief, fair or not, that employee lawyers just don't have the requisite independence.  Of course, it's a major affront to the professional dignity of in-house counsel and it's possible that the ruling will lead to less compliance with law at the margins.  (Although how we'd ever measure that is beyond me.)
