- Legal Profession Blog has the details on a North Dakota opinion holds that a lawyer representing himself pro se cannot directly contact an opposing party represented by counsel.
- Burdett v. Caselli: new, unpublished California Court of Appeal decision holding that a malpractice claim was not precluded by the anti-SLAPP statute, because the heart of the complaint dealt with sub-standard lawyering rather than petitioning activity. We continue to see a lot of confusion on this issue in California.
- Chan v. Lund: new, published California Court of Appeal decision rejected the claim of a settling party that his lawyer coerced him into settling. The opinion addresses -- and rejects -- a lot of legal theories (e.g., extortion) that the party asserted as grounds for backing out of the settlement. As you read the facts, you can readily imagine how difficult that settlement session was.
