Advertising and Direct Marketing Legal Clearance Checklist

By David Jacobson

ADVERTISEMENTS

The diversity of marketing channels now used was reflected in the interest shown in 2 posts last year: the note on Australian Competition and Consumer Commission v Singtel Optus Pty Ltd and the comment on website records retention.

Most laws are now technology neutral: they apply regardless of the method of communication.

Section 12 of the Electronic Transactions Act 1999 (Cth) sets out the requirements for retention of electronic communications.

You need to review both the content of your ads as well as where you place them. Laws and codes affect both aspects of advertising. And there may be further special rules that apply depending on the type of product or service.

Download the Langes Advertising and Direct Marketing Clearance Checklist (PDF) for an overview of clearance requirements.
