Bankruptcy Arizona: Causes, Part I

By Joseph McDaniel, Esq.

ADVERTISEMENTS
By far the most common reason people come to visit me is that they are being sued, finally.

That acts as a wake-up call; the debtors have been able to stuff their fingers in their ears until this point and say, "I can't HEAR You!" to collectors calling them on the phone to scare them into coughing up some dough.

And after the collectors gave up, it was fairly quiet for a while.

And they were able to duck the process servers for a while, because they're pretty resourceful, you know?

But ultimately the Judge will grant a Plaintiff Creditor the right to use alternative service, which isn't quite Sewer Service, to get the clock running.

As often as not, I'll want an Answer of some kind to go into the Court, because it usually takes a little while to tidy up the debtor for a bankruptcy in Arizona, whether they live in Gilbert, Scottsdale, Phoenix, Casa Grande, or anyplace else in Arizona.

And if they don't pass the Means Test, it's quite important that an Answer go in simply because some sort of strategy may be needed to quality for a Chapter 7, in the cases where that's possible.

And it's usually possible, so don't panic if you don't pass the Means Test on the first go-round.

Note that I said "possible"; I never said "easy".

Those are the guys on Television, right?

So do your homework and contact our firm; maybe we can help. Maybe not. But you probably ought to know sometime soon.
