: FinancialCounselCNBC Pundit Brian Kim Accused of Running $4 Million Ponzi Scheme
By James Eccleston
Brian Kim, a New York Hedge fund manager and CNBC pundit has been accused of operating $4 million Ponzi scheme that allegedly victimized at least 45 individual investors.
Kim and his hedge fund, Liquid Capital Management, LLC, were recently indicted on charges of grand larceny and felony violations of New York state securities fraud statutes by the New York district attorney?s office. In a separate action, the Commodity Futures Trading Commission commenced a lawsuit against Kim and his firm for similar allegations.
As early as January 2003, Kim is believed to have started soliciting investors to invest his scheme, which allegedly targeted technology professionals in Silicon Valley and Washington state. Kim held himself out as being a successful and experienced hedge fund manager who would invest their monies in safe securities that offered strong, predicable returns. Instead of investing the investor funds as promised, Kim allegedly incurred enormous trading losses in speculative futures contracts and diverted some the investor funds for his own personal use. Kim also allegedly concealed the losses to investors by falsifying account statements that showed fictitious returns on investment. Kim is believed to have improperly spent over $800,000 on personal expenses and to have used investor money to repay earlier investors in a classic Ponzi scheme manner.
Kim has appeared on CNBC?s financial news program ?Squawk Box?. In 2009, he is believed to have made two appearances on ?Squawk Box? his hedge fund, Liquid Capital Management.
