I could use an easy route and resubmit to Thomas and Scalia, but we already know that they are voting for the constitution. My concern is that twice during conferences the full court voted against the petitions, de facto against the constitution...

Over and over, people tell me they are discouraged about the "failed" lawsuits. It is true that lawsuit after lawsuit was dimissed, one after another (Cort, Donofrio, etc). However, this is not the time to lose heart. According to the Michigan Law Review special issue a few months ago on the "natural born citizenship" challenges to both Obama and McCain in court, it is unlikely that these controversies will be settled in court, because of the "standing" issue and "judiciability"...
