The prettiest thing you can wear to prom is a seat belt.

Personal injury isn't pretty. In fact some of what we see as P.I. lawyers makes us sick. Some makes go home at night when our children are little and sit on their beds just looking at them and hoping there will never be a day when they make some dreadful mistake or get caught up in something that leads to a tragedy...

Tort Reform Protocol: Oops! Sorry! The Apology, a new Gold Standard of Practice.

Posted on May 08, 2009
The claim is made that lawyers and lawsuits are to blame for the rising health care costs. The promise tort reformers make is to trust the bold and unproven assumption that costs of medical care will go down if you get rid of the law suits for malpractice...

MIDWEST Tort Reform News Roundup: Without p.i. law and lawyers you'd be screwed.

Posted on May 07, 2009
Do you believe the famous Shakespeare line often times misquoted as: The first thing we do, let's kill all the lawyers... That is what tort reformers hope you think every time you read about another lawsuit. That's why they put so much money into maligning the McDonald's burn case...

Texas Tort Reform Math: Your life + my mistake = your problem.

Posted on May 07, 2009
I was thinking maybe I should leave the Great State of Texas alone for awhile and allow them time to learn from their mistakes. But I can't do that. I take the lawyering job too seriously to just let it go. It seems wrong for professionals that make hundreds of thousands of dollars of income each and every year to ask patients who earn minimum wage to take financial responsibility for their professional mistakes...

Iowa Lottery: Is it being run as a criminal enterprise?

Posted on May 06, 2009
The Quad City Times published an editorial on Friday, April 24, 2009 that raises the question about whether Iowa lottery officials should be fired for not anticipating, investigating and then addressing the fraud that is rampant in the system. Anyone playing the lottery needs to read the Ombudsman's report investigating the Iowa lottery system and how a few very lucky people seem to be beating the odds of winning...

Do Texas malpractice caps work or is this just more hocus pockus?

Posted on May 06, 2009
After six years of limiting the quality of life damages in Texas for the most severely injured patients Texas is finding out that promises of lower health care costs is just another broken promise by politicians. In 2003 Texas amended its Constitution to allow the legislature to limit the recovery of patients and clients of medical service providers...

"I won't need a lawyer, because I'll be honest with the adjuster and they will with me."

Posted on May 05, 2009
After a car accident, for the most part many people start off thinking that being fair and honest will carry the day. Most people's definition of fairness and honesty has to do with talking long and telling it all and then the insurance benefit engine will start up and the claim will miraculously get settled...

Posted on May 04, 2009

My news alerts picked up this question and answer in SaddleBag World about the debate on whether helmets for motorcycle riders should be mandatory. This is tort reform we could really use. I'll say right now with so many other issues that need discussing I'm hoping not to have to go through this summer discussing this issue ad nauseum...
