: TortDeform.comSupreme Court Corp No More?
By Kia Franklin
Here's an interesting read in the Washington Post about trends in the rulings of the current Supreme Court. It suggests that perhaps the Court is more balanced than our pet name (Supreme "Corp" Court) implies. Might we need to modify this term of endearment? Recently the Court has actually made a handful of decisions that represent the interests of ordinary people (like this one and this one, for example).
It would be unfair to say that the Supreme Court is squarely pro-business, but a few good decisions won't let the Court off the hook. I am and we all should still feel burned by decisions like Ledbetter and Riegel v. Medtronic. And I agree with Prof David Vladeck, who was quoted in the WaPo article saying that Roberts, Scalia and Alito seem to be "particularly sympathetic to the needs of regulated interests." That's reason enough to continue to keep a watchful eye on the Court.
