In California, under California Vehicle Code Section 23123.5(a), a person my not drive a car while using an electronic wireless communications device to write, send, or read a text-based communication. This law is currently in effect and you can be cited for an infraction for violating this law with a first-time fine of $20 and $50 for every subsequent ticket. Also, you could be required to attend court which could greatly interrupt your school and/or work schedule. However, there are certain arguments that an attorney can make on your behalf to fight the ticket.
