: Dispatches from the Culture WarsKlinginschmitt Loses in Court. Again.
By Ed Brayton
Our old pal Gordon Klinginschmitt has lost again in court in his tireless campaign to make himself yet another false martyr to non-existent persecution. The DC Circuit Court of Appeals upheld the lower court's dismissal of his lawsuit claiming he was retaliated against for his Christian views. The court bluntly declared that because Pentagon regulations required that he be dismissed when he lost the endorsement of his church to be a chaplain, "the Secretary's initiation of separation proceedings could not have been motivated by retaliatory animus."
The ruling was unanimous and the panel included perhaps the most respected conservative Federal judge on the appeals court bench, Douglas Ginsburg. In fact, all three judges were Republican appointees. I suspect Klinginschmitt will now file cert with the Supreme Court, but they won't hear the case. Yes, I'm laughing.
