Legal Ethics Items (November 12, 2010)

ADVERTISEMENTS
  • When lawyers attack: a lawyer was disciplined for his conduct in a land dispute with a neighbor, during which the lawyer presented "evidence so weak and spurious as would make one question whether it was pulled from thin air."
  • Detroit News: "Lawyer says insults are just free speech."  "The attorney faces penalties on claims he called a police officer a "punk" and "dirty cop," and told another he hopes the officer gets "shot in a drug house in Detroit," among other R-rated taunts."  Lawyers get a different bundle of free speech rights than other do -- sometimes more speech rights, sometimes fewer.
  • People v. Loper: Supreme Court of Colorado case reversing the disqualification of the prosecutor.  Key passage: "We find that the trial court erred in disqualifying the district attorney under section 20-1-107(2), C.R.S. (2010) because there were no special circumstances that would make it unlikely that Loper would receive a fair trial. We therefore reverse the trial court?s order."
  • Williams v. Zugman: California Court of Appeal opinion (unpub'd) affirming dismissal of legal malpractice claim against criminal defense attorney.  "Because Williams has not proven actual innocence and is collaterally estopped from re-litigating that issue, we affirm the judgment."
  • News-Record (Greensboro): Women are now a majority of North Carolina's supreme court.
