ADVERTISEMENTS
  • Rogers v. Cape May County Office of Public Defenders, out of the appellate division of the Superior Court of New Jersey.  The defendant waited too long to sue the defenders office for malpractice.  In the underlying case, rather than identify and prepare witnesses, the defense counsel had arranged for the defendant's brother to dress like the defendant and switch places in the court room, thereby demonstrating that the prosecution's identification witnesses were mistaken.  Seriously.  It didn't work.  But neither did the malpractice claim.
  • Post-Crescent: DA serving on the Wisconsin Crime Victims Rights Board resigned after news that he has sent a complainant-victim multiple emails seeking an affair.
  • Virginia Lawyers Weekly reports on two cases from Virginia holding for lawyers in malpractice cases.
  • Legal Malpractice Law Review looks at an August case out of the USDC for the Northern District of Ohio, finding that certain legal malpractice claims were preempted by ERISA.  I knew second-hand that ERISA has strong preemption power, but as to state law claims for legal mal?
  • In the UK, there's concern that the military forces are losing lawyers who play vital roles in military operations.
