By Akin Gump Supreme Court Practice Group

ADVERTISEMENTS

If the Court issues orders today, we will report on them promptly.  This morning the Court will hear oral arguments in the following cases:

10 a.m. – In Alabama v. North Carolina (132 Original), the Court has agreed to hear an interstate dispute over enforcement of a regional pact on disposal of radioactive waste.

11 a.m. – In Briscoe v. Virginia (07-11191), the question before the Court is whether a prosecutor may, consistent with the Confrontation Clause of the Sixth Amendment, introduce a lab report as evidence at trial without calling the scientist who prepared the report to testify. Lyle Denniston of SCOTUSblog discussed the background and issues of the case this weekend in this preview.
