: Legal Pad | LADeath row inmate challenges new lethal injection procedures
By Richard Binder
Mitchell Sims, a 50-year-old death row inmate, has claimed in a suit that the California Department of Corrections and Rehabilitation has rushed through revising procedures for lethal injection, deliberately kept the public out of the loop, and consequently executions are likely to inflict excruciating pain if used on any of California's 700-plus condemned prisoners.
The suit claims the state never wanted public input into the execution procedure and didn't rethink its use of a three-drug protocol, which the suit argues isn't viable. Sara Eisenberg, Simms' attorney, told the Los Angeles Times that her client has exhausted all of his appeals.
The new, 80-page lethal injection procedure has been filed with the California secretary of state and is expected to take effect by Aug. 29.
