: Legal Pad | LAReview granted in Beverly Hilton case
By Richard Binder
The California Supreme Court has agreed to review an appeal filed by Oasis West Realty LLC, owner of the Beverly Hilton, against Southwest Homeowners Association President Ken Goldman.
Goldman represented Oasis for a time when he was with Reed Smith in 2009, in connection with Oasis's efforts to redevelop the Beverly Hilton. Two years after Reed Smith ended the representation, Goldman took some action in opposition to the redevelopment.
Oasis sued both Goldman and Reed Smith for breach of fiduciary duty, professional negligence, and breach of contract. The trial court found in favor of Oasis, but the California Court of Appeals then found for Goldman and dismissed the case, stating that "all causes of action in the complaint arose from acts in furtherance of protected activity."
Robert Barta, attorney for Oasis, has 30 days to file an opening brief.
