Tuesday, December 8, 2009
By Norman B. Arnoff and Sue C. Jacobs

"Norman B. Arnoff, a practitioner in New York City, and Sue C. Jacobs, a member of Goodman & Jacobs, write that there are a variety of contexts in which lawyers can find themselves presented with ethical issues that are in most instances resolvable by securing the client's informed consent and having that consent confirmed in writing so that it can be clearly established what the lawyer advised the client. However, an Oct. 26 opinion in the case by Judge Frederick Block, while not gaining the notoriety the trial verdict did, might be at least as significant for those practitioners dealing with the vexing issues surrounding the search and seizure of computer files."
