PRACTICE LIABILITY

Lawyers burned in Ponzi schemes

"The indictments of three attorneys in Florida and California raises questions about how lawyers may be drawn into committing alleged frauds such as Ponzi schemes. "They may see golden opportunities for themselves with investments or hedge funds," said Peter Keane, an ethics professor at Golden Gate University School of Law."

A small firm's rare story of growth

"The outlook is good for Denver firm Fairfield and Woods. The 42-lawyer shop is slowly growing at a time when many others are shedding lawyers, and business held steady in 2008, despite the fact that other firms saw a falloff. Managing partner Caroline Fuller credits the firm's diversification in its three core practice areas of real estate, litigation and corporate work."

IN-HOUSE

Arbitration rules may up legal costs

"Lawyers predict that new Financial Industry Regulatory Authority (FINRA) arbitration rules that sharply restrict when firms facing claims can file dismissal motions will drive up legal costs for financial companies defending employment and investor claims."

LAW SCHOOLS

Wanted: law school deans. Lots of them.

"Even in this economy, there seems to still be a demand for one high-paying job ? law school dean. At least 27 law schools throughout the country are searching for new deans ? and many are having a tough time filling the position."

LAW FIRMS

ABA may amend ethics rules on conflicts

"The American Bar Association will consider competing amendments to its ethics rules governing firm-to-firm movement and conflicts of interest at its mid-year meeting in Boston next month. One recommended change would ease the conflict of interest rule by allowing a law firm to "screen" an incoming attorney from the rest of its attorneys. But critics say the measure would put the convenience of lawyers ahead of the duty of loyalty to clients. "
