FROM THE UPCOMING ISSUE | Securities brokers fare well fighting sanctions
"For securities brokers and their firms, it pays to fight rather than settle regulatory complaints against them by the Financial Industry Regulatory Authority. A review of 2007 FINRA discipline proceedings found that litigating improved the chances that charges would be dismissed, financial fines lowered, suspensions shortened and even increase chances to keep resolutions confidential. 'The message is that whenever an individual or firm face regulators like the SEC or FINRA, they are often scared to fight given a regulator's resources, this study shows sometimes it may pay to litigate,' said Brian Rubin, the Sutherland Asbill attorney who authored the study."
"The American Bar Association issued a critical report about Florida A&M University College of Law that questions whether the school will be able to achieve ABA accreditation. The report caps months of bad news for the university, including a low Florida bar exam passage rate, an internal investigation involving the registrar's office and reports of poor morale among faculty. LeRoy Pernell, the law school dean who was hired in January to revamp the program, insists the report is old news and that he has made substantial changes and improvements since then."
"Henry C. Yuen, the former chairman and chief executive of Gemstar-TV Guide International Inc., was indicted on Tuesday on a felony charge of obstructing a Securities & Exchange Commission investigation. According to the new charges, Yuen allegedly deleted e-mails and Gemstar corporate documents that were requested as part of a subpoena in the SEC investigation."
"The Supreme Court of Kentucky elected John D. Minton, Jr., this week to serve as its next chief justice, picking a new leader for the first time in a decade. Minton, 56, will take the post June 27 when Chief Justice Joseph E. Lambert retires."
"The Chicago Bar Foundation has raised about $1 million from law firms and corporate legal departments in the city in its second annual campaign to funnel money to legal aid services for low-income residents. The foundation, with help from campaign chairman and Winston & Strawn partner Dan Webb, tapped 40 law firms and three corporate law departments to raise about 13 percent more than last year."
"Richard L. Gabriel, the lead attorney for the Recording Industry Association of America in its copyright infringement suits against individuals, has been appointed to the Colorado Court of Appeals. Gabriel, a partner and chairman of the intellectual property practice group at Denver-based Holme, Roberts & Owen, will take the official judgeship post on July 1."
