Tata America loses bid to force U.S. employees into arbitration in Mumbai

"A group of foreign employees who claim they were cheated out of their tax refunds have won the right to have their employment dispute heard in American courts, defeating efforts by India's largest conglomerate to force arbitration overseas. The U.S. Circuit Court of Appeals for the 9th Circuit on Friday denied a bid by Tata America International Corp. to compel arbitration and dismiss the class action that alleges it requires non-citizen U.S. employees to endorse and sign over their federal and state tax refund checks."

Florida A&M's College of Law overcomes struggles, wins full accreditation

"Just one year ago, the outlook was bleak for the Florida A&M University College of Law's bid to secure full accreditation from the American Bar Association. "A recent Nixon Peabody win stopped New Hampshire officials from transferring $65 million in surplus medical malpractice insurance funds to the state's general fund. The firm's July 29 victory in the Belknap County Superior Court case was the first round in its fight for New Hampshire health care providers against state officials."

THE PRACTICE

INADMISSIBLE

"Chevron no longer feels the heat for Pillsbury; public defenders demand an explanation for Ye Gon case dismissal; Senate Republicans hold up voting on several legal nominations; an Adams surfaces in the White House; FTC identity theft rules rankles the ABA; and Shearman & Sterling increases its IP litigation practice by two in this week's column."

OPINION

Free from court decrees

"The U.S. Supreme Court's June 25 decision in Horne v. Flores gave newly elected governors and mayors something to cheer about. The high court's rationale opens a door for officials in every state and most large cities to get out from ancient decrees controlling how they run many kinds of programs."
