FROM THE UPCOMING ISSUE | Real estate practices go abroad
"The subprime mortgage crisis, credit crunch and U.S. commercial real estate retraction that has forced some law firms to shed workers and lawyers is prompting other international firms to focus their real estate practices on overseas work. DLA Piper's real estate lawyers are focusing on helping U.S. companies, including financial institutions and hotel conglomerates, chase development opportunities around the globe, said Jay Epstien, a Washington partner who chairs the firm's U.S. real estate practice group."
"A key senator's recent ultimatum to the U.S. Department of Justice to change its policy on waiver of attorney-client privilege in corporate investigations likely will determine the fate of pending legislation that would make those changes in the current Congress. The action is supported by a coalition of business, civil rights and defense organizations who view legislation as the only practical option to address what it says is the widespread, coercive demand for waiver as a sign of cooperation by a corporation."
"The pace and scope of global corporate expansion has the biggest impact on in-house legal departments, according to attendees at a recent Association of Corporate Counsel Greater New York Chapter event. Of more than 100 senior corporate counsel polled at the event, 38.2% pegged global growth as having the most impact".
" 'A disciplinary committee of the State Bar of California is proposing a new rule that would require attorneys to face perjury charges if, in voluntarily resigning, they fail to state any criminal charges or convictions against them. The proposal comes after an attorney charged with possession of child pornography was alleged to have failed to report a guilty plea in his submission to voluntarily resign from the State Bar.' "
"What began this week as a class certification hearing on one of five national, high-tech price-fixing cases pending in San Francisco became a big score for plaintiffs after the judge asked what evidence they had of a conspiracy, then read aloud an e-mail by competing executives that suggests how to keep prices high. The suit combines at least 51 separate civil antitrust actions against Nvidia Inc. and Advanced Micro Devices/ATI Technologies Inc."
"UnitedHealth Group Inc., the Minneapolis-based health care provider that was sued over about $2 billion in unexercised backdated stock options, has agreed to pay $895 million to settle a federal class action. The proposed settlement, crafted by lead counsel Coughlin Stoia Geller Rudman & Robbins, is the largest involving stock options backdating claims in a class action."
