In many respects, Heller's past months have resembled Brobeck's last days: More than 50 partners have left in recent months, and merger discussions failed. The prospects for Heller's remaining 550 lawyers, who are spread throughout 14 offices, look bleak."

FROM THE UPCOMING ISSUE | A buzz about bridging pay gap
"The gender pay gap has always been a sore subject bubbling near the surface of law firms across the nation. Now it has boiled over the top. A recent report by the U.S. Census Bureau shows that women lawyers still earn far less than their male counterparts. The statistic didn't surprise anyone, but that didn't stop it from triggering a fresh round of debate on scores of blogs and within women's legal circles."

WEB-ONLY | U. of Michigan will let select students skip the LSAT
"The University of Michigan Law School is debuting a program in which a select group of students will be accepted without taking the Law School Admission Test, as applicants normally are required to do. The Wolverine Scholars Program will be open only to University of Michigan-Ann Arbor undergraduates who have completed at least their junior year and have a 3.8 grade-point average. Some in the legal community have criticized the change as an attempt to climb up the much-touted law school rankings."

WEB-ONLY | Unions' ability to enforce review of company outsourcing takes a blow
"The ability of unions to enforce contract terms that allow review of company outsourcing decisions suffered a blow in the 7th U.S. Circuit Court of Appeals in a hard fought legal battle that included three arbitrations and three appeals. A dispute between Ameritech Corp. and the International Brotherhood of Electrical Workers, Local 21, in Illinois, centers on a contract provision that allowed the union to review any contracting out of company work that would cause layoffs or part-time work or prevent rehiring of employees with seniority. In addition, some of those potentially lost, outsourced jobs could be allotted to union workers."

WEB-ONLY | Ten U.S. judicial nominees, solicitor general a step closer to confirmation
"Ten federal judicial nominees and the acting solicitor general got one step closer to full Senate confirmation Thursday, even as the Senate has been preoccupied with a bailout measure for the national financial crisis. Even the U.S. Supreme Court now has four ultraconservative justices. Courts have gutted consumer protection and anti-bias laws, attacked free speech protections and undermined voting rights principles. A return to Lochner-era jurisprudence would mean that more laws protecting citizens would be crippled. Americans of all political stripes need to realize that the high court is on the ballot, and the stakes could hardly be higher."
