Part 5.4 of 10: Will Katrina fight for the women with bound feet?

By Steve Lombardi

ADVERTISEMENTS

Under the CCP people like David Fitzgerald would be considered one of the "Women with bound feet." They were the aged, the young and the injured citizens who moved slowly and were thought to be a drag on Communist China's progress. They are the David Fitzgerald's of the American society. They are people without or who have lost their dignity.

Under a communist government officials take bribes and corruption becomes an accepted part of the system. It's just accepted. Consider frivolous Wall Street bonuses being paid as if public corporations were a money club existing for the benefit of the officers and directors; without regard for the shareholders. Jane Akre writes about this on the IB National News Desk.

Big Bonuses Paid To Departing Schering Execs, Jane Akre.

It's the same as graft being skimmed by communist government officials. In America it's just more out in the open because it's thought to be part and parcel of good capitalism. Consider the Madoff Ponzi scheme. How it is one man and perhaps a few of his family and friends can steal $50 billion US under the watchful eye of our own government. How is that possible if corruption is not firmly established and is now somewhat accepted as just another day's financial crimes? Why have so few corporate executives been charged in the sub-prime scandal after reaping billions in payouts, buy-outs and bonuses? The most obvious reasons are it's expected and accepted as part of who we are. We all want that multi-million dollar lottery ticket and so we turn a collective blind eye. Why isn't Congress after those corporate executives? Does their blind eye have to do with complicity in taking campaign contributions? Is it just a mill of corruption that greases the political machinery? Is this capitalism or communism?

Does our government represent the American people or the American business community?

Answer: (Add your comments below.)

At times when I listen to the arguments put forth from the business community and those advocating tort reforms I can think only of Communist Russia or the Chinese Communist Party. The damages they so freely refer to as non-economic are nothing but economic damages. It is real money paying real expenses and house bills that keep a family afloat. It's not play money and David Fitzgerald's pain and suffering money wasn't won in any litigation lottery. If you must see it as anything know that by having his arms and legs amputated, that he's earned every dime with his pain and suffering. Yes he and his family may also buy an ice cream cone or new shoes but still this is part of the economy of human suffering.

I've listened to the heated arguments by tort reformers orating as if what they say is a fact, when they know it is not fact. There is no proof to support the run-a-way verdict rational for increased malpractice premiums doctors are being charged. The actual unbiased research concludes verdicts and settlements are not the reasons for increased malpractice premiums being charged. Yet tort reformers continue to say they are the cause. Why do the lies persist and why are they so easily believed?

We are being suckered into buying tort reform that is nothing more than profit reform.

Business interests are taking it out of the pockets of working men and women and lining their own. America has seen politicians creating divisions within and between us; and yet we are simply all just working Americans struggling to stay afloat. This is true because no sooner does the stock market correct that my phone rings off the hook. When everyone thinks they are a millionaire they love to hate the lawyers. Greed is our middle name. Politicians are puppets that will do the bidding of business interests in return for campaign contributions. They pander for pay.

THE AMERICAN PUBLIC IS BEING DECEIVED

We all struggle with finances, but when times are good we allow them to divide us. There are those that have vs. the have-nots, Republicans vs. Democrats, war vs. peace, laborers vs. owners, gay vs. straight and religious doctrine being pushed to extremes and down our throats for the sake of driving profit margins.

And now there are those who take away dignity damages from the catastrophically maimed so they can take home a bigger multi-million dollar bonus or another jet or to purchase a mansion in Beverly Hills. The David Fitzgerald's get screwed and the wealthy get servants.

TEXAS IS IN DENIAL ABOUT THEIR GREED, IF YOU DOUBT IT JUST VISIT MR. FITZGERALD

The Texas legislature sickens me; I am appalled about what they did to David Fitzgerald. Appalled and ashamed that Texans like me are Americans. Texas greed obviously has no limit. Texans obviously don't see their own shame.

Interchange communism and red commies for frivolous lawsuits and PI trial lawyers; and see if there aren't some parallels.

And now we come to the economic and civil rights depression. Like the Soup Nazi, Texas tort reformers shout, 'No pain and suffering damages for you! Get out! You are banned from the soup kitchen."

We are in a great civil rights depression – shame is our middle name.

Our problem in America is more than just an economic depression. As Americans we are moving towards a civil rights depression, where the quality of life for Americans is cast-aside for the greed of the many who are not suffering; in this case the wealthy Baby Boomers and our parents.

And as members of the greedy bastards club we say go to hell, to the David Fitzgerald's in our midst. I suspect the economic meanness of our culture will speed up, rather than slow down. Things aren't yet bad enough for real change to occur. Our hearts are still rock hard and stone cold.

There was never a better time in my lifetime to be a lawyer. We have so much greed to fight against. We have so many injured people to fight for. We are the last defense against communism and those that try to destroy the American Dream. I am proud of those, like my step-daughter who fight their way into law school to become a lawyer. As she starts her law school career this fall at the University of Iowa she should know after learning the law life can never be the same. Your eyes see life differently. Your mind understands more about how society is supposed to work and how it is not working as intended by our forefathers. Like I said, after the first case is read you are on your way to appreciating better dead than red. Maybe she will become a litigator wielding Mother Justice's two-edged sword, for what is right. And if she does, maybe America will be a better place to live. Katrina Schaefer and the rest of the L1's at the University of Iowa College of Law, welcome to the practice of law.

Now if you think I'm going to give up on posting about Texas Tort Reform you're wrong. So don't hold your breath. I'm just warming up. Tomorrow let us look at how tort reform is packaged and marketed.
