Barzam WTF IV

Posted on June 19, 2009
Ok, fellow bar preppers (and any other law students and lawyers who want to chime in):It's time to play NAME THOSE TORTS!!18-year-old Kimberley, a Belgian teenager is suing Romanian tattoo artist Rouslan, claiming he put 53 extra star tattoos on her face after she fell asleep...

Ma'am

Posted on June 19, 2009
I internally cringe whenever I am called Ma'am.It makes me feel old. I don't like the feel of the word -- it is a little cold and unfamiliar and formal, and I tend to be a warm, open, informal kind of gal in my personal interactions. It strikes me as discordant when after a pleasant exchange with someone, I get a Thank You Ma'am or You're Welcome Ma'am or Take Care Ma'am...

Bar essays

Posted on June 17, 2009
I received back my essay from Bar/Bri. I missed the beginning of the lecture during which they discussed the essays, the average scores, etc. So I arrived at my seat and found my graded essay left there. I flipped it over and saw all of this red writing, and a nice "Good Job" and "Good IRAC" on the top...

Calming the f*ck down

Posted on June 16, 2009
I just worked on two bar practice essays and was freaking out because apparently my issue spotting radar is broken. I was writing about the admissibility of character evidence when the examiners wanted relevance. I was writing about business records exemptions when the examiners wanted statements against penal interest...

Stolen Lines #5

Tell me... have you ever thought...of changing your life?I am sitting on the floor. It is cold... it is one of those concrete floors on the ground level with some industrial tile laid over it. Probably asbestos. Fleeting thoughts like that cross my mind, my back uncomfortably leaning against a green tile wall...

MILP #102: *Insert adverse possession double entendre here*

If I say this post is about Obama, do you think I'll get more or fewer readers?

Posted on June 11, 2009
I worked on a small project with someone who now has a high profile position in the Obama administration. IM conversation with a friend of mine who worked on the same project:Friend: That's interesting. He is now officially the most influential/powerful person I have ever met...

Barzam WTF III

Posted on June 10, 2009
A suit commences in state X by service of process but in state Y by filing a process with the court clerk and under FRCP by filing a complaint with the court. FRCP doesn't allow for interlocutory appeals, nor does state X, but state Y does a matter of right...

Final final grades

Posted on June 08, 2009

Barzam WTF II

Posted on June 06, 2009
Criminal Procedure.Have I been seized?I don't know. Look around. Is a police officer brandishing his weapon? Does the tone and demeanor of the officer make a reasonable person not feel free to leave? Have you been told you can refuse to consent to this little chat?I am running, actually...

Don't most four year old boys say they want to be astronauts or firefighters when they grow up?

Posted on June 04, 2009
Mommy, where does God come from? Who made God?Well I don't know. I do know that when you grow up you can read a lot of books that will have different ideas about the answer to that. I don't know the right answer, but when you're bigger you'll have to read the books and decide which one you think is the right answer...

MILP #100

Pt-Lawmom has the 100th round-up and she has come up with a fitting tribute indeed.Part of the reason we started the round up, I think, was to collect a bit of shared wisdom about surviving law school pregnant or with kid(s) in tow. I think we accomplished that, and my archives are often searched by women looking for answers to the heart-felt and occasionally bizarre questions...

Tee-Ball

Posted on May 30, 2009
Today was Clownfish's first tee-ball game of 2009 (as opposed to practice):If this post looks familiar, see last year's post.Player #5 hit the ball and ran toward third.Player #7's dad grabbed his son's hand and ran down the baseline with him. It was absolutely the only way that kid was getting anywhere near first base...

And he should know... you should see his Ns

Posted on May 29, 2009
Clownfish and I went out for dinner last night. We got two mints from the waiter when we were done. Clownfish was concerned we wouldn't have one to share with Bullshark, so I let him keep mine to give to his father. Bullshark didn't get home til late and is always out early in the morning, so Clownfish wrote him a note (with a little spelling help from me):PapaFor youClownfishThis morning, Clownfish awoke to discover Papa had taken the mint and had left him a note in return (my idea)...

WTF Wednesday

Posted on May 27, 2009
Today, I salute you Mr. Chevy Truck Driver.I'm sure you've been told that you have real cajones, and you wanted to make sure that the world knew that those were golf ball sized chrome plated cajones. That's why, hanging from your trailer hitch, you had those classy truck nuts swinging away as you sped through suburbia...

Bar Prep Begins in Earnest

Posted on May 27, 2009
After four hours of video lecture, I am thinking that booze is in order. It is going to be a long summer.

Comfy

Posted on May 26, 2009
Clownfish drew a picture of the three of us snow skiing. Yes, I realize it is summer. During winter he was drawing pictures of us at the beach. Yesterday he was asking about Halloween. He's never happy with the season he is in because he understands that they change...

Makes me want to cut a bitch

Posted on May 22, 2009
BarBri Lady: Hopefully you narrowed it down to A or B. I mean, its obviously admissible. B is the better answer because blah blah blah blah. So it is B.I picked D.Ok... I think some time off in in order.

Barzam WTF

Posted on May 21, 2009
The first in what I imagine will be a series of WTF moments while studying for the barzam.Today's episode: evidence: hearsay exceptions.Bride collapses at wedding after drinking champagne. Declares to onlookers while gasping for breath: "I knew my new husband wanted my money...

American Idol

Posted on May 19, 2009
I've been pretty (blog) quiet about AI this season, except for this post in which I called the guy who will probably win this thing a d-----bag. I didn't like him then, I don't like him now, and I still don't understand why the judges practically begged America to put him in the finals...

Don't judge me

Posted on May 18, 2009
Yes. That's him. That's my kid. He is the one wearing two completely different colored socks to preschool today.Yes, I intentionally let him leave the house like that. No, really, I do love him. I'm not a neglectful parent. This was his choice. He wanted his friend to "laugh his head off" and apparently wearing a black dress sock and a white sports sock with his Spiderman sneakers and khaki shorts would accomplish this goal...

Bar application

Posted on May 13, 2009
The Bar application for my state was painful. How painful? I have experienced the following things and would rather do them again before filling out the bar application again.Things LESS painful than my state's bar application:* root canal* child birth by cesarean* four wisdom teeth pulled simultaneously* broken toeI hope there is not a next time...

A boy and a stick

Posted on May 12, 2009
I took Clownfish to the beach yesterday. It was far too cold for swimming but he wanted to karate chop the waves (hiyah!) and that was the location he chose for our post-grad Mommy-Clownfish picnic. We built a sandcastle and a moat and then the castle was condemned for flooding and was washed out to sea...

...but I am pretty sure I know where to look it up

Posted on May 11, 2009
In your first week of law school, when a professor asked you a question, you could look at him honestly and answer "I don't know." Three years later, having read tons of case law, having immersed yourself in scholarly articles, and having spent hours and hours puzzling out UCC and the IRC and other statutes, when someone asks you a question, you can now confidently answer "It depends...
