Posted on July 01, 2008
Let's make July the month the trade union workers work safe by working smart. Starting in July we are going to cover accidents, safety equipment, the law, OSHA rules and regulations and some aspects of construction sites. Over the last 27 years my clients have overcome general contractors who refuse to set the job site up right or to control what goes on...

Post Disaster Planning - Iowa Lawyers Under Water Seek Assistance

Posted on June 28, 2008
Linn County , Iowa is two and one half hours away from West Des Moines , Iowa where I live. As far as the lawyers who work in downtown Cedar Rapids are concerned it might as well be on the moon. The water in downtown Cedar Rapids went high enough that it breached the 500 year flood plane zone...

The flooding has caused havoc in the Midwest and with the water receding additional problems are not just being uncovered but discovered. A railroad bridge collapsed late in the day Tuesday. Injured was the engineer in charge of moving the locomotive and cars off of the bridge that had been place to secure the bridge from being damaged by the raging flood waters...

Victoria's Secret lawsuit is not so bad. If you doubt it just ask its CEO.

Posted on June 25, 2008
If you haven't yet read the Complaint from the Victoria Secret "thong" lawsuit, you should.. I think this young lawyer means well, but his judgment is not yet ready for the practice of law. Of course the pundits will have a hay day with this one and the late night talk shows are provided with what they need for a good humorous monologue...

Tort Reform gets Borked!

Posted on June 24, 2008
Nothing makes tort reformers angrier then when tort reform measures are used against their claim. You see they like tort reform, so long as it applies to you. In their own minds they are special and different from you and me. They unlike us are more worthy of pain and suffering damages...

The Cigarette Constitution - It's the same one brought to you by the Tobacco Institute Reformers

Posted on June 23, 2008
Today I get to write from the heart. The Iowa legislature finally passed a ban on smoking in public businesses with the exception of Veteran's Homes and casinos. The Veteran's Homes I can understand from a political standpoint, but the casinos being exempted has me baffled...

Might I remind you about the tort reformists, how you voted and Mr. Niemoller's poem?

Posted on June 22, 2008
GMA did a story about a cruise line passenger having a heart attack and how the medical staff seemed preoccupied and never seemed to have the time to really examine the man before he passed on. And now everyone is up in arms. Chris Cuomo, having graduated from Fordham University's law school is well qualified to understand the issues involved...

Don't be fooled by tort reform. You too are just one accident away from my office.

Posted on June 21, 2008
Yesterday we saw how creative sentencing can look pretty splashy on the front page of the newspaper. Today we examine how what seems popular gives the public a false sense of security and can lead the Court to faulty reasoning and making an unsound decision...

Creative sentencing like tort reform may not be based on good judicial reasoning

Posted on June 20, 2008
For well over ten-years my injured clients have been impacted by the faulty reasoning of tort reformers who deform recovery rights while conveying just the opposite message. I've watched as legislation is titled with names conveying one message while actually doing the opposite...

Tort Reform - How the politics of fear clouds our minds about what is right and wrong.

Posted on June 18, 2008
It's titled, The downside of tort reform by Arnold Wax, M.D. Dr. Wax is a medical oncologist from Nevada. He's been active in promoting tort reform measures that have largely been implemented in that state. He recently experienced a clear case of substandard medical care that he was convinced would result in a fair result in her favor...

Are employee incentives as beneficial as they seem?

Posted on June 17, 2008
A few days ago around on the incentive programs being offered to workers by many construction companies and affiliate organizations.  The idea behind such programs is that, by providing various types of rewards for abiding by and maintaining safe environments, construction workers will make every attempt to ensure safe working conditions and decrease the risk of an accident on the work site...

Tort Reform - Radiologist / Wrongful Death Claim Post Draws Criticism

Posted on June 16, 2008
A Dade County, Florida physician commented after reading Tort Reform - Radiologist tired of waiting, hangs up phone - treating physician doesn't get message - patient dies. Interesting enough his comment had nothing to do with feeling remorse for the patient's family grappling with her untimely death or the problems with the health care system that caused a positive finding to not be relayed to her treating physician...

Tort Reform - Radiologist tired of waiting, hangs up phone - treating physician doesn't get message - patient dies

Posted on June 15, 2008
There have been several posts about how after tort reform some products and services take on the appearance of being at the level and quality of what you can expect while visiting an undeveloped country. But Ben Glass' story about the case of Tameika Williams vs...

Fire Prevention 101

Posted on June 11, 2008
We all learned the basics of fire-safety when we were just children.  In the event of a fire, stay low to the ground.  Should you come in contact with the fire, stop, drop, and roll.  Yadda-yadda-yadda.     These bits of advice are only relevant in the event that a fire does occur...

Stale medical bills,

Posted on June 10, 2008
QUESTION: I was asked a question about stale medical bills and it seems to be a reoccuring problem. The question has to do with stale medical bills and a delayed billing by the medical service provider. The billing was not originally made and when it was, six years later, it was too late to file with the responsible parent's health insurance carrier...

Work Comp - Work place injuries and immigrant worker rights

Posted on June 07, 2008
When did an honest day's work become a crime? If being a common laborer weren't tough enough, immigrant workers doing the work that our kids won't now have to worry about being arrested amass for visa violations. I for one am sick and tired of listening to immigrant workers get bad mouthed about working in this countrywhen all that they aredoing is an honest day's work for low wages...

Accidentally backing over another worker can be prevented.

Posted on June 06, 2008
Just recently my office settled an accidental back over case and so the news item by the Gazetteonline.com from Cedar Rapids caught my attention. You might wonder how this can happen and how to prevent it from happening to you or your loved one. OSHA has rules that apply to certain industries that are designed to reduce the number of fatalities from backing over someone at a work site...
